Article 2 : Definitions

 

When capitalized, the following terms have the meanings specified below :
GCU : refers to these General Terms and Conditions of Use of the www.my-water-manager.com website and the MY WATER MANAGER mobile application.
Website or Customer Platform : refers to the www.my-water-manager.com website, published by MY WATER MANAGER
Application : refers to the free mobile application MY WATER MANAGER, published by MY WATER MANAGER and compatible with Android and iOS operating systems.
User : refers to any natural person using the www.my-water-manager.com website or the MY WATER MANAGER mobile application, under their sole responsibility, and who has previously accepted these General Terms and Conditions of Use. Users are either Member Users or Non-Member Users.
Member User : a user who has subscribed to MY WATER MANAGER on its Website and can create profiles and authorisations for non-member Users. The member User is the one who has, within the installation, the roles of resident Administrator or non-resident Administrator.
Non-member User : a user who has not taken out a subscription on the Website and who does not have the rights and authorisations offered to member Users. The non-member User is the one who has, within the installation, the roles of Operator or Occupant or User or Child or Restricted or Blocked.
Services : refers to the various services offered to different types of Users (members and non-members) by MY WATER MANAGER on the Website and the Application.
Reserved Services : refers to Services reserved for User Members who have taken out a subscription with MY WATER MANAGER on its Website.
Personal data : means any data relating to an identified or identifiable natural person.
Subscription : subscription taken out with MY WATER MANAGER on its Website in order to benefit from the reserved Services.
Customer account : personal account accessible on the Customer Platform and the Application and enabling access to the Services.
Module : Connected device installed on the User’s pipes enabling MY WATER MANAGER to take measurements in order to provide its services.
Box : Device installed on the User’s premises that enables communication with MY WATER MANAGER’s infrastructure.
Installation : refers to all the hardware made available to Users by MY WATER MANAGER (Modules and Boxes).
Installer : refers to the person authorised to create an Installation under the conditions defined in article 7.1 of the GCU.

Zone : refers to a specific water area equipped with a set of MY WATER MANAGER modules (bathroom, kitchen, etc.), which may include several water points (washbasin, sink, shower, toilet, etc.).
 

 

Article 3 : Preamble and opposability

 

The purpose of these GCU is to provide a legal framework for the provision and use by the User of the Application and the Website as well as the Services offered by MY WATER MANAGER.
These Terms and Conditions are available on the Site and the Application under the heading «Terms and Conditions».
Any use of the Site or the Application implies the User’s unreserved and unrestricted acceptance of these GCU. When the User registers on the Customer Platform or creates an account on the Application, the User is invited to expressly accept these GCU by ticking the box before the following text: «I acknowledge that I have read and understood the GCU and I accept them».
If the User does not accept the GCU, he or she will not be able to access the Services offered on the Site and the Application.

MY WATER MANAGER reserves the right to unilaterally modify the content of these GCU at any time.
 

 

• Article 4 : General presentation

 

MY WATER MANAGER’s mission is to prevent water wastage and water damage by enabling consumers to monitor consumption and detect leaks throughout the installation.
To this end, MY WATER MANAGER offers an innovative and eco-responsible solution for remote control and management of all sanitary installation equipment via the Application.
The operating principle is based on several autonomous communicating modules interconnected at strategic points in the sanitary installation.
These modules measure flow rate and incorporate a solenoid valve. They enable the sanitary installation to be divided into several zones, each of which is controlled independently.
MY WATER MANAGER enables Users to use the Application to control the flow of water, detect water leaks and manage their water consumption.
The MY WATER MANAGER mobile application is completely free of charge and does not contain any built-in purchases.
The Subscription offered by MY WATER MANAGER can only be taken out online on the MY WATER MANAGER website and constitutes the consideration for the use of the services offered by MY WATER MANAGER and under no circumstances the consideration for the use of the Application and the functions offered therein.
This Subscription is not linked to the Application but to the management of data, the network and the various functions relating to the products and services marketed by MY WATER MANAGER.
Most of the Services accessible from the Application are also available on its Internet version (accessible on the MY WATER MANAGER Website), with the exception of certain services exclusive to the Application (see article 8 below).
However, payments cannot be made directly via the Application.
The Website, including the Customer Platform, is intended more for the presentation of the Services, the management of the User’s Account and the payment of their Subscription.

 

Article 5 : Access to the Website and the Application

 

5.1 Access to the Website
The Website is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User’s expense.
Consultation of the Website does not require any minimum technical configuration. However, in order to enjoy optimal browsing comfort and performance, it is recommended that you use the latest version of the browser concerned.
Users of the Website undertake to access it using virus-free equipment.
5.2 Access to the Mobile Application
Anyone wishing to use the Application must first download it onto their terminal. 
The Application can be downloaded free of charge from the Apple Store for the IOS operating system and from the Play Store for the Android operating system.
 Downloading the Application requires the following technical configurations:

– At least Android version 11 or iOS version 12.1
 

 

• Article 6 : Prerequisites for access to Reserved Services

 

6.1 Accuracy of information
By agreeing to subscribe to the reserved Services conditional upon taking out a Subscription on the Website, the Member User undertakes to provide only truthful and accurate information about himself or about non-Member Users.
If incorrect information is provided voluntarily, access to the reserved Services may be interrupted.

6.2 Validating registrations and creating an Account
To create an Account on the Application, the User must provide the following information :
• E-mail address
• Name
• First name
•Telephone number
To create an Account on the Customer Platform, Users are asked to enter their Installation number.

His details will then be retrieved from his Customer Account previously created on the Application and the User will be asked to confirm his identity by selecting the «yes it’s me» option. Their details will then be used to create an Account on the Customer Platform, once their email address has been verified.

 

• Article 7 : Créer, rejoindre et utiliser une Installation via l’Application

 

7.1 Creating an Installation
In order to guarantee the safety of the Installation and the correct installation of the MY WATER MANAGER modules, the creation of an Installation is strictly reserved for Installers who are plumbing professionals.
Any creation of an Installation by a person who is not a professional plumber is strictly forbidden.
In order to verify compliance with this requirement, the creation of an Installer account on the Application implies compliance with the following conditions :
– First of all, the installer is asked to certify on his honor that he is a plumbing professional.
– The installer is then asked to enter the code reserved for professionals that was given to him by the distributor
   from whom he collected the MY WATER MANAGER products (boxes and modules).
If these conditions are not met, the User will not be authorised to create an Installation.
Once the Installation has been configured, the Installer no longer has access to it unless he is granted access again by the Administrator, for example for the purpose of replacing an element of the Installation.
The Installer’s contact details are displayed in the Installation details to enable the User to contact him if necessary.

7.2 Joining an Installation
7.2.1. Joining a facility that has no members
A User can join a Facility by scanning the QR Code of one of the pieces of equipment making up the Facility. If this Installation does not yet have a member, the User will then be assigned the role of resident or non-resident Owner, depending on whether or not they live in the dwelling corresponding to the installation.
The role of Owner (resident or non-resident) confers on the User the status of User member, as well as a certain number of privileges detailed in point 7.2 below.
The User member is then invited to create an account on the Customer Platform, or to connect to their account if one already exists. The purpose of this step is to activate the Installation and create an identification link between the Installation and the User.
7.2.2. Joining a Facility that already has a member(s)
A User cannot join a Facility that already has member(s) by scanning the QR Code. The only way to join the Facility is to respond to the invitation sent by a User member already present in the Facility (resident or non-resident Owner) or an Administrator and to download the Application.
Once the invitation has been accepted, the User may join the Facility via the Application and will be assigned the role of Resident Administrator or Non-Resident Administrator or Operator or Occupier or User or Child or Restricted or Blocked by the User member already present in the Facility (as Resident Owner or Non-Resident Owner).

 

7.3 Roles and privileges for using a Facility
The Facilities do not allow several User members to live together.

The User member who has the role of Resident or Non-Resident Owner on an Installation must carefully assign the roles he wishes to the Users who wish to join the Installation. Once the Installation has been activated, MY WATER MANAGER declines all responsibility for the allocation of roles granted by the first User member to Users who join his Installation via an invitation.

Consequently, MY WATER MANAGER wishes to inform Users of the importance of controlling the roles and privileges of each User, identified as follows ::

Article 8 : Description des Services

8.1 Description of the Services accessible on the Website
The Website gives Users access to the following Services :
▪ Creating and managing a Customer Account : the Website enables Users to create and manage their Customer Account.
▪ Subscribing to a Subscription online : the Website allows the User to subscribe to a Subscription in order to benefit from the various Services offered by MY WATER MANAGER. To do this, the User must enter their Installation number, which can be accessed from the Application. If the User does not yet have a Customer Account, they will be invited to create one. After checking the number of Modules and Boxes installed, the User will be able to pay for their Subscription on the Website. Payment for the Subscription must be made on the Website.
▪ Access to invoices : the Customer Platform provides access to invoices ;
▪ Cancellation and management of the Subscription : the Customer Platform allows the User to manage and possibly cancel their Subscription.

 

8.2 Description of the Services accessible on the Application
It should be noted that access to and use of the Application are entirely free of charge, the Application corresponding to a mobile interface enabling the Installation to be viewed. No payment may therefore be made via the Application, as the Subscription offered by MY WATER MANAGER to access certain specific services may only be taken out online on its Website.
The Application gives Users access to the following Services :
▪ Creating and managing a Customer Account : the Application enables Users to access their Customer Account by entering their e-mail address and password. They can also change their password and preferences  (language, notifications, items per page).
▪ Access to general information about the User’s Installation (daily consumption, estimated cost, statistics,  etc.)
▪ Access to information specific to a Zone : the User can access real-time consumption for a specific Zone
▪ List, add and configure a water point : the User can access the precise consumption of a specific water point  (e.g. a washbasin), manage the desired level of leak detection and control the valve mode according to their wishes.
▪ Control of a Module in a water point : the User has access to the status of a particular module (battery level, connection status, notification), its consumption in real time, valve opening data and the desired leak detection level.
▪ Listing, adding and checking Modules : the User has access to all Modules used, which can be checked separately as specified above.
▪ List of alerts : Users can access all the alerts issued on their Installation (current or already identified) as well as general information about the system.
▪ Scenario list and control : the User has access to the list of existing scenarios, which can be configured to program the operation of each of the equipped Zones.
▪ List, add and check Boxes : the User has access to the list of Boxes in use and can add a new Box using a QR CODE (see below).
▪ List, add and control Zones : the User has access to the list of Zones in use and can add a new Zone by specifying its characteristics.
▪ List and control of Users of an Installation : the User can access the list of other Users of the Installation and add – if they have a Subscription
Non-member Users to manage the Installation. The Main User can assign roles to each additional User for the whole Installation or for a specific Zone.
▪ QR CODE reader : enables the User to enter the serial numbers of Modules and Boxes without having to copy them out by hand. To do this, the User must authorize access to his mobile camera via the Application before scanning the QR Code reproduced on the Modules and Boxes.
▪ Configure Box Wifi settings : allows users to connect their Box to their Wifi connection.
▪ Join an Installation : enables a User to join an existing Installation to become a member or non-member User.
The above Services are also available on the Website, with the exception of the QR Code reader, the configuration of the WiFi settings of a Box and the possibility of joining an Installation, as these services are only available via the Application.
Non-member Users do not have access to all the Services reserved for member Users, as these depend on the settings made by the member User benefiting from a Subscription.
All Users of the Application benefit from Services linked to the management of their account (modification of password, modification of functional preferences) and to the possibility of joining one or more Installations, the other functionalities offered to them depending on the rights assigned to them by the Administrator or Owner.
To access the Services, User Members must identify themselves using their login and password, which will be sent to them after registration.
To access the Services, non-member Users must download the mobile Application. They can then create, access and manage their Account from the Application. To access other Services such as consumption monitoring, the non-member User must be invited by a member User or take out a Subscription on the MY WATER MANAGER website in order to become a member User.

 

 

• Article 9 : Changing information and unsubscribing

 

All Users may modify their personal information at any time by going to the «Profile» section of their personal space, accessible from the Website and the Mobile Application.
The Member User alone is able to unsubscribe a Non-Member User by deleting their profile. The User member can unsubscribe by cancelling his Subscription and the non-member User can also leave the Installation if he wishes by clicking on the «Leave installation» button in the «My installation» menu.

• Article 10 : Account security

 

The User is obliged to change his/her temporary password in accordance with MY WATER MANAGER’s requirements. The User is solely responsible for the confidentiality and strength of the password chosen to secure access to his/her personal Account.
In particular, the User is invited to follow the recommendations of the CNIL regarding the choice of a sufficiently strong password.

The User is invited to renew his/her password regularly and undertakes never to communicate it to a third party in order to preserve the security of the information linked to his/her account.
Any disclosure of the password, in whatever form, is prohibited. The User assumes all risks associated with the use of his/her login and password.
If the User forgets his/her password, he/she can initiate a password change procedure via the «Forgot your password?» link accessible from the Application login page. An email will then be sent to the user inviting them to follow the necessary steps to change their password.

 

 

Article 11 : Personal data

 

In the context of the provision of the Services and in the context of its commercial relations, MY WATER MANAGER is likely to implement personal data processing in its capacity as data controller which concerns Member Users and Non-Member Users.

Article 13 : Intellectual property

 

Trademarks, logos, distinctive signs, company names and all the content of the Website (text, images, sound, etc.) are protected by the French Intellectual Property Code.
The MY WATER MANAGER brand is a registered trademark of MY WATER MANAGER. Any representation and/or reproduction and/or partial or total use of this trademark, of any nature whatsoever, is totally prohibited.
Any person must request prior authorization from MY WATER MANAGER for any reproduction, publication or copy of the various contents. Member Users and non-member Users undertake to use the contents of the Website in a strictly private context, any use for commercial or advertising purposes being strictly forbidden.
Any total or partial representation of this site by any process whatsoever, without the express authorization of the site operator, would constitute an infringement punishable by articles L.335-2 et seq. of the French Intellectual Property Code.
The same applies to the extraction and re-use of the content of the databases accessible on the environments offered by MY WATER MANAGER, which are protected by the provisions of the Law of 1 July 1998 transposing the European Directive of 11 March 1996 on the legal protection of databases into the Intellectual Property Code (Articles L.342-1 et seq.).

• Article 14 : Responsibility

 

The sources of the information published on the MY WATER MANAGER Website and Application are deemed reliable, which does not guarantee that they are free from defects, errors or omissions.
The information provided is for general guidance only and has no contractual value. Despite regular updates, MY WATER MANAGER cannot be held responsible for changes in administrative and legal provisions occurring after publication.
Similarly, MY WATER MANAGER cannot be held responsible for the use and interpretation of the information contained in its sites and mobile applications, unless this information is directly related to the service(s) provided.
MY WATER MANAGER cannot be held responsible for any viruses that may infect the computer or any other IT equipment of the Internet user, following use, access or downloading from its sites and mobile applications.
Once the Installation has been activated, MY WATER MANAGER declines all responsibility for the allocation of roles granted by the first User member to Users who join his Installation via an invitation.
Lastly, MY WATER MANAGER may under no circumstances be held responsible for the consequences of an Installation created in contradiction with the requirements of these GCU, in particular if the Installation has not been created by a plumbing professional.

14.2 Hypertext links
Hypertext links may be present on MY WATER MANAGER websites or mobile applications. Users are informed that by clicking on these links, they will leave the site or mobile application concerned.
MY WATER MANAGER has no control over the web pages to which these links lead and cannot under any circumstances be held responsible for their content.

14.3 Responsibility of Users
Users acknowledge that they may be held liable for any use of the Application, the Website or their constituent elements that is inconsistent with the content hereof (and in particular the articles relating to the description of services and intellectual property).
Similarly, Member Users acknowledge that they alone are responsible for adding non-member Users, and that MY WATER MANAGER has no obligation to monitor the creation or allocation of roles and privileges that may be decided by the latter.

14.4 Major force and fortuitous events
MY WATER MANAGER cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party, as defined by French law.
MY WATER MANAGER shall not be held liable for any event due to force majeure that results in a malfunction of the sites, mobile applications or servers, subject to any interruption or modification in the event of maintenance.
In such cases, Users accept that the service may be interrupted or suspended, even without prior notice.

 

 

Article 15 : Miscellaneous provisions

 

The fact that MY WATER MANAGER does not avail itself of one of these provisions, or of one of the provisions contained in another document binding on Users, may not be interpreted as a waiver of the right to avail itself of any of these provisions at a later date.
In addition, if any provision or part of any provision of these TOU is held to be unlawful, void or unenforceable, such provision or part thereof shall be deemed severable from these TOU and shall not affect the legality, validity or enforceability of any remaining provisions (except as required by applicable law).
15.2 Complaints and resolution of disputes
Insofar as MY WATER MANAGER offers its solutions, services and products to audiences that are different in the eyes of the applicable legal provisions (professionals or consumers within the meaning of the Consumer Code), Users acknowledge that their disputes will be governed by the provisions of the General Terms and Conditions of Sale applicable to them, which have been communicated to
the User, who can find them in the footer of the Customer Platform or the Mobile Application, or who can ask MY WATER MANAGER to send them to them.
1.3 Applicable law
French law applies to this contract. In the event of failure to resolve a dispute between the parties amicably, the French courts shall have sole jurisdiction.

▪ Names and email addresses are only visible to users in the same zone with user management rights (Administrator, Operator, Occupant).
▪  Consumption data is only visible to residents (Resident Administrator, Occupant, User, Child, Restricted), depending on the role the user has assigned himself. Each user is free to assign the role they wish and will therefore have access to the data concerned accordingly.
▪  Alerts are passed on to all relevant users of the installation (depending on the zone).

You have the right to access, rectify and delete your data.
You also have the right to restrict or object to the processing of your personal data. You also have the right to port your personal data. In addition, you have the right to define general or specific directives concerning the use made of your data after your death.
